On this website, you will find:

a novel called Who Killed JA? - The novel is provided to give a storybook context to the records. It is not truth.

medical records - In addition to the actual records, there are excerpts from the records which have been annotated to demonstrate how a "chart review" might highlight areas where standard of care, an important consideration for the medical negligence aspects of this litigation, may have been breached. The annotations will also demonstrate where there are possible inconsistencies in the charting. The annotations may be of some value to attorneys and others interested in providing assistance.

court documents - The court documents are the filings that have been presented to the court in the civil matter before it.

a sincere request for help and ways you can participate in possibly affecting the future of this litigation and your future sick care.

a discussion blog - This is a place for exchanging thoughts about the different possibilities leading to JA's death. The blog is unmoderated and in no way represents my feelings about anything. I will occasionally read some of the posts on the blog. The input may affect if and how I proceed with this matter.

Of necessity, this website is a work in progress. The contents will change over time. There are some links that are not yet active and there will be changes made to chapters in the novel as time passes. Certainly, the legal filings will change over time. When a major change is made, I will post notification of it.

Links leading to external sites may no longer work as websites change.

By the way, if you are wondering why the font is so large, I made this choice so more people, including older persons and those with some visual impairments, can more easily view the content. If you find it annoying, your browser may allow you to decrease the appearance of the font size.

Also this site is pretty low-tech so as to present the fewest obstacles.

My name is Michael Applebaum.

I am an MD.

My father was JA, Joseph Applebaum.

Because there is pending civil litigation, please note that any words in the novel are simply possibilities which may or may not reflect how I actually feel or what I actually think, but my disclaimers can be considered as true.

Regarding my true thoughts, the truth, the whole truth and nothing but the truth will be conveyed through the legal filings and to a jury if and when the appropriate time comes.  

 

What Happened?

JA entered the hospital on December 01, 2003 for an elective procedure, not an emergency.

The next day, December 02, 2003, he was dead.

You can guess, correctly, that I am of the opinion that something went wrong since there is a civil lawsuit resulting from this hospital admission.

The suit was filed December 01, 2005.

Do not let my bias persuade you one way or the other. Decide for yourself what happened. You will have access to virtually all the information I have and everything that I know to be in the public domain.  

 

Who Killed JA?

This is a unique website. To the best of my knowledge:

Yes, you read it correctly. By participating in Who Killed JA?, you may be able to affect the outcome and YOUR life, too. (Here's how.) This is a possible "side effect" of putting the case online in my efforts to comply with the judge's "suggestion" to get help. When you become aware of the issues involved, you may see opportunity to cause an effect on the system.

Based on a true story, this website, Who Killed JA?, will present real medical records and court documents that will allow you, the reader, to do step-by-step sleuthing to decide for yourself: Who Killed JA? - Was it malpractice, something else or nothing at all?

If he/she chooses, any visitor will get to decide in his or her own mind who killed JA. You might even decide no one killed JA.

This website will speak to the Sherlock Holmes, Columbo, CSI fan and Quincy, ME in each of you. I hope this is interesting enough a prospect to get the help the court wants me to obtain (see pages 22-25).
